What is the driver posting declaration?<\/span><\/h5>\t <\/div>\r\n\t \t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The IMI declaration is a document certifying that your company's drivers are paid the minimum wage in the countries where they operate: loading, unloading, or cabotage.<\/p>

The driver posting declaration must be generated from the European platform no later than entry into the country concerned. The declaration is not required in the country of origin.<\/p>

An operator established in a member state must register information about the driver's posting in the European IMI platform before the posting begins.\u00a0<\/p>

The driver posting directive also includes a few exceptions where this document is not required. These exceptions include, for example, bilateral transport. (Romania \u2014> Italy \u2014>Romania)<\/p>

From this date on, authorities in European countries should no longer require foreign hauliers to register their posted drivers in national systems.<\/p>

However, national websites may still be used by operators from non-EU countries.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Under the new legislation, you must provide, at the request of enforcement authorities, certificates for your drivers for each EU country, including the United Kingdom, where you carry out operations, but not for countries you only transit.\u00a0\u00a0<\/p>

A driver posting declaration can be issued for a minimum of one day and a maximum of six months; once it expires, a new declaration must be created.\u00a0<\/p>

The portal stresses that a declaration is required even for haulier operations lasting just one day.<\/p>

Enforcement officers in a given country have the right to ask foreign drivers for the posting declaration, either printed or in electronic format sent by the operator to a phone or tablet.<\/p>

The authenticity and validity of the posting declaration are checked on the spot by scanning the QR code on the declaration (the check is done in real time via IMI).\u00a0<\/p>

Officers may later decide to send the company a request for additional documents proving that the driver received appropriate pay for the posting period.<\/p>

Document requests are made via IMI, so the competent authority in the operator's country (e.g., the Labor Inspectorate in Romania) may be responsible for requesting the data from the haulier.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Posted drivers must carry the following documents:<\/p>

\u2013 the posting declaration in printed or electronic format;<\/p>

\u2013 proof of the transport operations taking place in the host member state, such as the e-CMR document;<\/p>

\u2013 tachograph records (especially the country symbols of the member states where the driver carried out transport operations).<\/p>

\u2013 documentation on the driver's pay for the posting period;<\/p>
