A1 form – recommendations and essential information

A1 form for drivers: recommendations and when it is mandatory

In short: The A1 form is the document proving that an employee remains insured under the Romanian social security system while working in another EU or EEA country or in Switzerland, so that social contributions are paid in a single country. In Romania it is issued by the National House of Public Pensions (CNPP), based on an application filed by the employer, with different forms for posting and for multi-state employment. For transport companies, the document must be requested in advance and kept valid for every driver who operates outside the country.

In the first part of this article, we outlined what the A1 form is, how to obtain it, what conditions you must meet, and other factors related to obtaining the A1 form.

In this article, we will present some important information about using the A1 form, tips on managing it, and other aspects related to administration and efficiency.

When is the A1 form mandatory for international travel?

The A1 form is a document issued by the competent authorities of a European Union (EU) or European Economic Area (EEA) member state to certify the employment status of a person who is temporarily posted to work in another EU/EEA country. This form proves that the person remains subject to the social security legislation of the country that issued the form.

In general, the A1 form is mandatory when a person is posted to another country for a fixed period and continues to be employed by a company in their home country. It shows that the person does not have to pay additional social security contributions in the host country during the posting period.

In short, as long as you work on a posting outside your home country (in our case Romania), you need this A1 form to prove that you have paid the social security contributions due in Romania and do not have to pay them again in the country where you work.

How does the A1 form affect postings in the EU?

The A1 form has a significant impact on postings within the European Union (EU), as it keeps track of certain aspects essential to the labor market. The A1 form is important first and foremost for health insurance coverage, but also for regulating certain aspects for employers regarding the differences between EU or EEA states. Here are a few ways the A1 form affects postings in the EU:

  • Determining the applicable social security legislation: The A1 form is used to establish in which country the posted worker must pay social security contributions and receive social benefits. This is important to avoid double contributions and to ensure that workers continue to enjoy their social security rights during the posting period.
  • Preventing unfair competition: Using the A1 form helps prevent unfair competition between companies from different EU countries. This is because posted workers who hold an A1 form remain subject to the social security legislation of their home country, which means that all social costs (such as pension contributions, health care, etc.) remain largely the same for their employers.
  • Facilitating the free movement of labor: The A1 form helps promote the free movement of workers within the EU, as it simplifies administrative procedures and provides clarity regarding their social security status.
  • Compliance with EU regulations: Using the A1 form complies with EU regulations on the coordination of social security systems between member states. This helps ensure a clear and uniform legal framework for posted workers within the EU.

Social security coverage through the A1 form

The A1 form is essential for social security coverage of workers posted to another country in the European Union (EU) or the European Economic Area (EEA). This form certifies that the posted worker remains subject to the social security legislation of their home country for the duration of the posting, which means they will continue to enjoy the social rights and benefits they would normally have had in their home country.

With the A1 form, the posted worker and their employer are exempt from paying additional social security contributions in the destination country for the duration of the posting. Instead, they continue to pay social security contributions under the legislation of the home country.

This saves you additional costs and gives you peace of mind throughout the posting period.

Frequently asked questions about the A1 form

Who issues the A1 form in Romania and how do you apply?

In Romania, the A1 form is issued by the National House of Public Pensions (CNPP) through its international relations departments. The application is filed by the employer, most easily online, through the application and document submission section of the CNPP portal. There are separate application templates depending on the situation, including one dedicated to domestic and international road haulage companies. The institution states that the form is issued within a reasonable time, provided a complete file is submitted.

How long is the A1 form valid for a posting?

In a posting situation governed by Article 12 of Regulation (EC) No. 883/2004, the worker remains subject to the legislation of the home state provided that the anticipated duration of the work abroad does not exceed 24 months. A second condition is that the posted person is not sent to replace another previously posted person. The actual validity is the one stated on the document.

What type of A1 form do drivers who operate in several countries need?

International transport drivers usually fall under multi-state employment, governed by Article 13 of Regulation (EC) No. 883/2004, rather than classic posting. Multi-state employment means salaried work carried out simultaneously or alternately in two or more member states. In this case, the legislation of a single state applies, and contributions on all income are paid there, which is what the A1 form certifies.

Does the A1 form replace the posting declaration in the IMI system?

No, they are two separate obligations. The A1 form concerns social security and is issued under Regulation (EC) No. 883/2004. The driver posting declaration stems from Directive (EU) 2020/1057 and is submitted to the host state’s authorities through the public interface connected to the IMI system, no later than the start of the posting period. Both may be requested during an inspection, along with other transport documents.

What does a company risk if a driver is inspected without an A1 form?

Not having the A1 form during a roadside check or a labor inspection in the host state can lead to penalties under that state’s national legislation and to a demand that the employer pay social contributions there, in parallel with those already paid in Romania. Checking the document is a routine part of posting inspections, so its absence also triggers additional checks on the company.

When should the A1 form be requested, before or after the trip starts?

The A1 form is requested before work abroad begins, so that the document is already on board the vehicle or available to the employee at the time of an inspection. Obtaining it involves processing time at the pension house, and starting the process too late is the usual reason drivers end up leaving without the document. Some states temporarily accept proof of the submitted application, but the rule remains to apply in advance.

How does a company keep track of multiple A1 forms for its drivers?

In practice, a person or team is appointed to centralize all applications and issued documents, with standard procedures for requesting, renewing and archiving them. The key is a centralized record showing until when each document is in effect, so that renewal starts in good time. For large fleets, the process can be outsourced to a specialized consultant who also tracks legislative changes.
